1. Drawing Period: The San Antonio Life in the 4G Fast Lane Drawing (the “Drawing”) begins 6:00 p.m. Central Time (“CT”) on January 21, 2010 and ends 9:00 p.m. CT on January 21, 2010 (the “Drawing Period”).
2. How to Enter: Official Entry Forms will be available at the San Antonio Life in the 4G Fast Lane Concert Event at the Historic Sunset Depot in San Antonio, TX (“Event”), while supplies last. Complete the Official Entry Form and deposit entry in the ballot box at the Event by the end of the Drawing Period. Limit one entry per person. Entries must be complete to be eligible. Entries become the property of Sponsor and will not be returned.
3. Prizes and Approximate Retail Value (“ARV”): Grand Prizes (2): Each Grand Prize Winner will receive Sponsor selected flatscreen TV and six (6) months of cable service from Time Warner Cable, awarded in the form of a certificate. The ARV of each Grand Prize is $1,100. [6 months free Digital Cable, Digital Phone, and Road Runner and Road Runner Mobile. No cash value, non-transferrable, must be redeemed at TWC Service Center and expires 6 months after the date of event]. First Prize (1): A Sponsor-selected laptop computer. The ARV of the First Prize is $1,500. Second Prize (1): One year of Road Runner 4G/3G Service, awarded in the form of bill credit. The ARV of the Second Prize is $779.88. Third Prize (1): A (size tbd) leather racing jacket. The ARV of the Third Prize is $699. Fourth Prize (1): One year of Road Runner 4G Service, awarded in the form of bill credit. The ARV of the Fourth Prize is $539.88. Fifth Prize (1): A Samsung Mondi™ cellular phone. The ARV of the Fifth Prize is $399. Sixth Prize (1): A Dual-mode card (3G/4G). The ARV of the Sixth Prize is $199. Seventh Prize (1): A Single-mode card (4G). The ARV of the Seventh Prize is $99. Any difference between the ARV and the actual value, if any, will not be awarded. Prizes are nontransferable and must be accepted as awarded. No cash or other substitution may be made. In the event the Event is cancelled due to circumstances beyond Sponsor’s control, prizes will not be awarded. All taxes, fees and surcharges on prizes are the sole responsibility of winners, if applicable.
4. Winner Selection: You must be present at the Event to win. Prize winners will be randomly selected and announced after the Event ends on or around 9:15 p.m. from among all eligible entries received during the Drawing Period. If any potential winner does not respond within five (5) minutes of his/her name being called during the announcement of the potential winner, such potential winner will be disqualified and an alternate winner will be selected from among the remaining eligible entries received during the Drawing Period, in Sponsor’s sole discretion. This process will be repeated for up to until a potential winner responds, if time permits, in Sponsor's sole discretion.
5. Release: Each potential winner must prove eligibility, including, without limitation, proof of age and residence, at the Event. In the event of non-compliance by a potential winner, such potential winner shall be disqualified and all privileges otherwise due as a winner shall be terminated and an alternative potential winner may be chosen per the process described in Section 4, if time permits, in Sponsor’s sole discretion. Each winner must sign: (a) an affidavit of eligibility and release of Sponsor Entities from any and all liability, loss, claims, demands, and causes of action for personal injury and/or damage, theft, loss, or any other harm suffered in connection with this Drawing or the use/misuse or acceptance of the prize, as applicable, or any portion thereof to be eligible for a prize; and (b) except where prohibited by law, a promotional release granting Sponsor Entities the right to use his/her name and likeness for advertising and publicity purposes without additional compensation. Entry into this Drawing constitutes agreement to sign such releases. The Promotion Entities (as defined in #6) shall have no liability or responsibility for any claim arising in connection with participation in the Drawing or any prize awarded. Participants assume all liability for any injury or damage caused, or claimed to be caused, by participation in the Drawing or use or redemption of any prize.
6. Eligibility: The Drawing is open to legal U.S. residents, 18 years of age or older as of January 21, 2010 who are Event attendees. Time Warner Cable Inc. (“Sponsor”), Road Runner, Don Jagoda Associates, Inc. and each of their respective parent companies, divisions, affiliates, subsidiaries, advertising and promotion agencies and other participating companies in the Drawing and each of their respective officers, directors, representatives, agents and employees (collectively the “Promotion Entities”) and the immediate family members and/or those living in the same household of such officers, directors, representatives, agents and employees are not eligible to participate or win. Void outside TX and where prohibited or restricted by law. Subject to all federal, state and local laws and regulations.
7. General Rules: No responsibility is assumed for lost, illegible or late entries. The Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Drawing; violates these Official Rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any attempt by any person to deliberately undermine the legitimate operation of the Drawing may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
8. Jurisdiction: The Drawing shall be governed by and interpreted in accordance with the laws of the State of New York applicable to promotions fully carried out within New York. Except where prohibited by law, any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Drawing but in no event attorneys' and/or experts’ fees; and winners hereby waive all rights to claim punitive, incidental and consequential damages and any other damages (including attorneys fees), other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Each winner acknowledges that no other party nor any agent or attorney of any other party has made any promise, representation or warranty whatsoever, express or implied, not contained herein concerning the subject matter hereof, to induce the winner to execute any document and winners acknowledge that they have not executed any document in reliance on any such promise, representation or warranty not contained herein. Any waiver by the Sponsor and its affiliates of any term of any document in a particular instance shall not be a waiver of such term for the future. Each winner agrees that the invalidity or enforceability of any part of any document shall in no way affect the validity or enforceability of any of the remainder of that document.
